Build & Blossom Company, also known as Build X Blossom Co., provides website design, brand consulting, branding graphics, and digital marketing services to clients. Our goal is to deliver high-quality work that meets our clients' needs.
Eligibility
To use our Services, you must be at least 18 years old and have the legal capacity to enter into a contract.
2. Accounts
To access certain features of our Services, you may be required to create an account. You agree to provide accurate and complete information and to keep this information up to date. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.
3. Payments and Pricing
Pricing
All prices for our Services are listed on our website or provided through a custom quote. Prices are subject to change at our discretion. Once you receive a quote, the price quoted is valid for one day from the date of the quote.
Payments
Payments are due upon receipt of an invoice unless otherwise specified. We may offer installment payment options at our discretion, and all payments must be completed in full prior to the delivery of final work.
Refunds
Due to the nature of our Services, we do not offer refunds. If you have concerns about the quality of work delivered, please reach out within 24 hours of receiving the deliverables, and we will work to address your concerns.
4. Client Responsibilities
To ensure a smooth workflow, clients are expected to:
Provide any requested materials, feedback, or approvals within the agreed timelines.
Ensure that the content provided to us does not violate any third-party rights or laws.
Promptly notify us of any issues or changes in project scope.
5. Intellectual Property
Ownership of Work
Upon receipt of full payment, we grant you a limited, non-exclusive license to use the deliverables for their intended purpose. Build & Blossom Company retains all intellectual property rights to any designs, concepts, or other works created during the project unless otherwise agreed in writing.
Use of Your Content
You grant us a non-exclusive, worldwide, royalty-free license to use your content for the purposes of providing the Services. You affirm that you have the right to provide any content you share with us.
6. Limitation of Liability
To the fullest extent permitted by law, Build & Blossom Company shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from or relating to our Services shall not exceed the amount you paid us for the Services in question.
7. Confidentiality
Both parties agree to keep confidential all information, data, and materials that are designated as confidential or reasonably understood to be confidential. This includes, but is not limited to, project details, trade secrets, and other proprietary information.
8. Modifications and Termination
We reserve the right to modify or discontinue any portion of our Services, with or without notice, at any time. We may also update these Terms from time to time, and the latest version will be available on our website.
You may terminate your relationship with us at any time by discontinuing the use of our Services. However, termination does not relieve you of any payment obligations for Services rendered.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state of Michigan/United States of America, without regard to its conflict of law principles. Any disputes arising from or related to these Terms shall be resolved in the courts of Michigan/United States of America.
